Welcome to Pomki Embroidery! These Terms of Service ("Terms") govern your use of our website located at pomkiembroidery.nz (the "Site") and the purchase of any products or services from us.
By accessing or using our Site and purchasing from us, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, please do not access the Site or use our services. 
1. General Conditions & Eligibility
  • Modifications: We reserve the right to update, change, or replace any part of these Terms at our discretion by posting updates on our Site. It is your responsibility to check this page periodically for changes. 
  • Age of Consent: By using this site, you represent that you are at least the age of majority in your region of residence, or that you have given us your consent to allow any of your minor dependents to use this site. 
2. Products, Pricing & Accuracy
  • Handmade & Custom Variations: Because our birth-stat plushies, keepsakes, and apparel are custom-made or machine-embroidered by hand/studio operation, slight variations in thread colors, plush placement, or fabric texture may occur compared to digital mockups or photos.
  • Pricing: All prices on our Site are listed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) if applicable. We reserve the right to change prices at any time without notice. 
  • Accuracy of Billing: We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. 
3. Custom Orders & Proof Approvals
  • Digital Proofs: For customized and personalized items, we email a digital design proof for your review. Production and turnaround times begin only after you approve this proof.
  • Customer Responsibility: You are entirely responsible for verifying the accuracy of all text, spelling, dates, and numbers provided in the design proof. Pomki Embroidery is not liable for errors or typos that were present in the digital proof approved by the customer.
4. Intellectual Property
  • Content Ownership: All graphics, logos, text, design layouts, and embroidered artwork displayed on this Site are the intellectual property of Pomki Embroidery. 
  • Prohibited Use: You may not reproduce, duplicate, copy, sell, or exploit any portion of our embroidered designs, product imagery, or Site content without express written permission from us.
  • To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986), Pomki Embroidery shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our products or Site. Our total liability for any claim shall not exceed the purchase price of the specific item paid by you.
  • Note for Business Consumers: If you are acquiring our goods or services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply. 
6. Governing Law
  • These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising shall be subject to the exclusive jurisdiction of the New Zealand courts.
